Terms and Conditions
I. Scope of application
1. The General Terms and Conditions (hereinafter referred to as GTC) apply to all contracts and orders concerning the purchase or delivery of tickets (hereinafter referred to as tickets) or vouchers for the show production "Stars in Concert" of S.I.C. Stars in Concert Veranstaltungs GmbH, including such contracts concluded with suppliers etc. This applies regardless of whether the purchasers are consumers, entrepreneurs or merchants.
2. All agreements made between you and us in connection with the purchase contract are based inparticular on these Terms and Conditions of Sale, our written order confirmation and our declaration of acceptance.
3. The valid version on which these GTC are based is decisive for the conclusion of the contract.
4. We do not accept deviating terms and conditions of the customer. This shall also apply if we do not expressly object to their inclusion.
5. Third-party events are sold exclusively in the name and for the account of the respective organiser. This means that the event is organised by the organiser who is also the issuer of the ticket. By purchasing the ticket, contractual relationships with regard to attending the event are established exclusively between the ticket holder (hereinafter referred to as the customer) and the respective organiser. The organiser's own general terms and conditions may apply to these legal relationships.
6. In the event that the General Terms and Conditions of the third-party organiser and the General Terms and Conditions of S.I.C. Stars in Concert Veranstaltungs GmbH contain contradictory provisions, the General Terms and Conditions of S.I.C. Stars in Concert Veranstaltungs GmbH take precedence over the specific terms and conditions of the third-party organiser.
7. Insofar as the event tickets (hereinafter referred to as tickets) are sold by Estrel Hotelbetriebs- GmbH, it acts in the name and for the account of S.I.C. Stars in Concert Veranstaltungs GmbH, whereby the contractual relationship is established between the customer and S.I.C. Stars in Concert Veranstaltungs GmbH.
II. Schedules and events
1. The current programme and starting times can be found on the official website of S.I.C. Stars in Concert Veranstaltungs GmbH: https://tickets.webbuchen.com/stars/jsp/page1.jsp
2. S.I.C. Stars in Concert Veranstaltungs-GmbH reserves the right to change the announced line-up at short notice.
3. There is no admission after the start of a performance. Exceptions are the responsibility of the organiser.
4. The instructions of the staff must be followed. The staff exercises domiciliary rights on behalf of S.I.C. Veranstaltungs GmbH. Customers may be denied access to the performance and exhibition venues by the admission and supervisory staff if they do not behave appropriately or if there is reason to believe that they will disrupt the performance or exhibition or harass or discriminate against other customers. Such persons may also be expelled from the premises.
III. Ticket sales and cancellation
1. In the case of orders by e-mail, we accept the customer's offer within two days by sending a declaration of acceptance in a separate e-mail.
2. When placing an order via the online shop on the website of S.I.C. Stars in Concert Veranstaltungs GmbH at the URL: https://tickets.webbuchen.com/stars/jsp/page1.jsp or another site operated by us that incorporates these GTC, a contract is concluded by you first submitting an offer to conclude a contract on our site after you have selected the respective products and placed them in the shopping basket, entered your contract data and desired payment method and then clicked the "Buy" button and then acceptance by us takes place by the payment transaction being carried out by our service provider or the selected payment service provider (see below in section V.3.). You can recognise erroneous input by having the contract data displayed again immediately before clicking the "Buy" button. You can correct such input errors by going back via the relevant button in the form. The language available for the conclusion of the contract on our website is German. The text of the contract is saved by us, but is no longer accessible to you via the Internet after you have placed your order; however, we will send you the order data and our General Terms and Conditions in text form.
3. If the customer merely makes a reservation, this does not constitute the conclusion of a contract unless the customer has already paid the purchase price at the time of the option date. In this sense, the purchase price is paid when it has been credited to the account of S.I.C. Stars in Concert Veranstaltungs GmbH or payment has been made in cash on the same day. This also applies if an order number and an option date are assigned when the reservation is made. Reservations are made as follows:
a. An order number is assigned and an option date determined when the reservation is made.
b. The order number, option date and ticket price will be confirmed to the customer by telephone, verbally or in writing. A claim to the purchase of tickets and delivery of the tickets exists only and exclusively only if the ticket price has been credited to the S.I.C. account or paid in cash by the option date.
4. The customer purchases event tickets in his own name and for his own account.
5. It is not permitted to take a seat other than the one indicated on the ticket. If a customer changes seats without authorisation, S.I.C. Stars in Concert Veranstaltungs GmbH may charge the difference or expel the person concerned from the seat indicated on the ticket or from the performance.
6. The access authorisation is only transferable to third parties under the following conditions: The third party may not pay a higher price than the price printed on the event ticket plus advance booking and system fees and must assume all rights and obligations arising from the event attendance contract – including the ban on resale – and enter into the contract with the organiser in place of the transferor.
7. Passing on event tickets to third parties is not permitted in the following cases without exception:
a. The transfer or sale of event tickets or the purchase of event tickets for a third party, if this is done in the context of a commercial or business activity, without the prior express consent of the organiser,
b. the sale of event tickets via internet auctions that are not authorised by the organiser,
c. the sale of event tickets in order to make a profit, or a purchase of event tickets on behalf o a third party in order to make a profit from the brokerage activity,
d. passing on and/or selling event tickets for advertising or marketing purposes as a bonus, promotional gift or prize or as part of a hospitality or travel package not authorised by the organiser,
e. or in the case of a sale of event tickets without reference to these General Terms and Conditions.
8. Any violation of these conditions will result in the loss of access authorisation to the respective event without compensation. The admission ticket loses its validity.
9. For each violation of the aforementioned prohibitions, S.I.C. Stars in Concert Veranstaltungs GmbH may also demand payment of an appropriate contractual penalty of up to € 2,500.00 from the customer, the amount of which may be reviewed by the competent courts in the event of a dispute. Further claims for damages remain unaffected by this. S.I.C. Stars in Concert Veranstaltungs GmbH expressly reserves the right to exclude persons who violate this prohibition from purchasing tickets in the future or to initiate criminal proceedings.
10. S.I.C. Stars in Concert Veranstaltungs GmbH is entitled to cancel a customer's order for which a transaction number / order number / request number has already been allocated (unilateral right of withdrawal) if the customer violates specific conditions set by the organiser and / or S.I.C. Stars in Concert Veranstaltungs GmbH and / or if there are outstanding claims from the previous business relationship with the customer. The declaration of cancellation / withdrawal can also be made implicitly by crediting the amounts paid.
11. The aforementioned right of cancellation is subject to §§ 346 et seq. BGB (German Civil Code) under exclusion of § 350 BGB.
12. Admission tickets sold cannot be returned or exchanged.
13. In the event of rescheduled events, the organiser is entitled to declare the validity of the original tickets for the rescheduled event for the new, rescheduled date of the event. In such cases, it is not possible to return the tickets to the organiser or to cancel the ticket purchase as a result of the postponement, unless it can be proven that the ticket holder cannot reasonably be expected to attend the postponed event. This does not apply if the organiser is responsible for the postponement of the event.
IV. Ticket returns and refunds
1. The return of sold tickets is generally excluded. This also applies to changes to the line-up.
2. This does not apply to the cancellation of events. The right to return tickets expires after two years at the latest. Further expenses or damages incurred by the person concerned as well as the online sales fee will not be reimbursed unless S.I.C. Stars in Concert Veranstaltungs GmbH has caused the cancellation of the event or exhibition intentionally or through gross negligence.
3. For events organised by third parties on the premises of S.I.C. Stars in Concert Veranstaltungs GmbH, claims must be asserted directly against the external organiser.
4. There is no entitlement to a replacement if tickets are lost. If a customer loses the tickets purchased, a replacement ticket can be issued at the ticket office as a gesture of goodwill if it can be credibly demonstrated which ticket was purchased. The customer of the original ticket has priority over the holder of a replacement ticket. The replacement ticket does not entitle the customer to be allocated a different seat.
V. Prices and payment methods
1. All ticket prices for our events are gross prices including statutory VAT and do not include any shipping costs that may be incurred.
2. The shipping costs are stated in the prices in our online shop. In the case of a ticket reservation by telephone, this is expressly pointed out. Furthermore, the shipping costs incurred will be shown in the order confirmation.
3. Customers can use PayPal as a payment method for orders via the online shop. If the customer wishes to use PayPal (not credit card, purchase on account or payment by instalments), they must be registered with PayPal or first register and legitimise themselves with their access data and confirm the payment instruction to S.I.C. Stars in Concert Veranstaltungs GmbH. The payment transaction will be carried out by PayPal immediately after the order has been placed.
4. For orders that are not placed via the online shop on our website, payments can be made in cash or by bank transfer, direct debit or crossed cheque, whereby in the case of non-cash payments, payment is only made when has been finally credited to the account of S.I.C. Stars in Concert Veranstaltungs GmbH.
5. Claims for reductions must be made at the latest when the contract is concluded, so that any claims made at a later date will not be taken into account. If there is a claim to a reduction and this was submitted in good time, proof of this is required before admission. If this proof is not provided, the difference to the full ticket price must be refunded.
6. If the contractual declaration is effectively cancelled in accordance with VII., customers can demand reimbursement of costs already paid for shipping to you (shipping costs) under the statutory conditions.
7. Tickets that have not been paid for on time will be returned to sale.
8. The ticket loses its validity when leaving the venue.
VI. Ticket collection and dispatch

VIII. Ticket collection and dispatch
1. Paid tickets will be sent to the customer by postal dispatch at their request. The delivery time is approx. 2 - 5 days, maximum 7 days.
2. If the customer purchases the tickets from an agency, the place of fulfilment is the business premises of this agency.
3. Deposited tickets (box office) must be collected up to 30 minutes before the start of the performance, stating the order number.
IX. Revocation
1. Unless exceptions apply, consumers have a right of cancellation for distance selling contracts, about which we provide information below in accordance with the statutory model. The exceptions to the right of cancellation are regulated in section VII.2. A sample cancellation form can be found in section VII.3.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).

You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.
To exercise the right to cancel, you must inform us (Stars in Concert Veranstaltungs GmbH, c/o Estrel Berlin, Sonnenallee 225, 12057 Berlin, Telephone number: +49 30 6831 0, Fax: +49 30 6831 2345, E-Mail: ticket@estrel.com) of your decision to cancel by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to cancel this contract. You can use the attached sample cancellation form, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.
Consequences of cancellation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.
You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired. The customer shall bear the cost of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
2. The right of cancellation does not apply to contracts for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery. There is also no right of cancellation for consumers in the case of contracts for time-limited tickets. Each ticket purchase is therefore binding immediately after confirmation of purchase via the webshop and obliges the customer to accept and pay for the tickets. Furthermore, there is no right of cancellation for contracts for the delivery of audio or video recordings in a sealed package if the seal has been removed.

X. Image and sound recordings
1. Customers are prohibited from making image and/or sound recordings of any kind. Violations may result in civil and criminal prosecution. Furthermore, in the event of violations, the house staff is entitled to confiscate and retain recording material of any kind on which parts of the performance are recorded. The return of the recording devices may be made dependent on the owner agreeing to the prior deletion of the recordings.
2. In the event that during a public performance, visit to an exhibition or other event organised by S.I.C. Stars in Concert Veranstaltungs-GmbH, image and/or sound recordings are made by persons authorised to do so, customers agree by participating in the event that they may be recorded in image and sound without entitlement to remuneration and that these recordings may be broadcast or published.
XI. Liability
1. S.I.C. Stars in Concert Veranstaltungs-GmbH is liable for damages for which it and its representatives and vicarious agents are responsible arising from injury to life, limb or health and from claims based on data protection law.
2. In the event of damage caused in any other way, S.I.C. Stars in Concert Veranstaltungs-GmbH shall be liable in accordance with the statutory provisions in the event of intent and gross negligence, including that of its representatives and vicarious agents.
3. S.I.C. Stars in Concert Veranstaltungs-GmbH is only liable for negligently caused property damage and financial loss, including for its representatives and vicarious agents, in the event of a breach of a material contractual obligation, but limited in amount to the damages foreseeable and typical for the contract at the time of conclusion of the contract; [material contractual obligations are those whose fulfilment characterises the contract and on which the customer may rely.
4. S.I.C. Stars in Concert Veranstaltungs GmbH assumes no liability or guarantee for the accuracy, completeness, timeliness and quality of the information provided, nor any liability in connection with the use of the information or reliance on its accuracy, completeness, timeliness and quality. In particular, S.I.C. Stars in Concert Veranstaltungs GmbH is not liable for information from third parties such as agencies or publications for information from external events.
5. pyrotechnic, lighting or stroboscopic effects may be used at events. All customers, especially those who are prone to epileptic seizures, are advised to inform themselves about the pyro/light/strobe effects used in good time before purchasing tickets and before the event and to check this with a doctor before attending. A corresponding warning will also be issued on site at the event.
XII. Wardrobe
1. Coats, umbrellas, poles, large bags and similar items as well as recording devices and cameras of all kinds must be handed in for storage at the cloakroom for a fee.
2. Liability for cloakroom items shall only extend to the current value. The cloakroom is not available to customers for valuables, in particular jewellery, other items made of precious metals, cash and other means of payment, business papers, documents of all kinds, tickets and keys. These items are stored at the customer's own risk.
3. Upon presentation of the cloakroom ticket, the stored items will be handed over without verification of authorisation. Cloakroom items may only be handed over without a stamp if it can be credibly demonstrated that you are the authorised recipient.
4. Cloakroom items that have been exchanged, damaged or lost, as well as the loss of a cloakroom ticket, must be reported to the cloakroom staff immediately before leaving the cloakroom facility. If a cloakroom ticket is lost, the person concerned is obliged to reimburse the replacement cost .
5. Items of any kind found in the performance and exhibition venues of S.I.C. Stars in Concert Veranstaltungs-GmbH must be handed in to the house or cloakroom staff. The further handling of lost property is governed by the provisions of §§ 978 et seq. BGB.
XIII. Special bookings, exclusive shows
1. In the case of special events, S.I.C. Stars in Concert Veranstaltungs GmbH is entitled to claim advance payments in accordance with the respective contractual agreements.
2. If the advance payment is not made even after a reasonable grace period set by S.I.C. Stars in Concert Veranstaltungs GmbH has expired, S.I.C. GmbH is entitled to withdraw from the contract.
3. Furthermore, S.I.C. Stars in Concert Veranstaltungs GmbH is entitled to withdraw from the contract, if:
a. force majeure or other circumstances or measures by third parties for which S.I.C. Stars in Concert Veranstaltungs GmbH is not responsible make the fulfilment of the contract impossible;
b. events were booked with misleading and/or false information regarding material facts, e.g. the organiser or the purpose of the event;
c. S.I.C. Stars in Concert Veranstaltungs GmbH has reasonable grounds to believe that the event may jeopardise the smooth running of the business, the safety or the public reputation of S.I.C. Stars in Concert Veranstaltungs GmbH.
4. S.I.C. Stars in Concert Veranstaltungs GmbH must inform the organiser of the exercise of the right of cancellation without delay.
5. In the event of cancellation by S.I.C. Stars in Concert Veranstaltungs GmbH for the abovementioned reasons, any claim for damages by the organiser against S.I.C. Stars in Concert
Veranstaltungs GmbH is excluded.
6. If the organiser or hirer is unable to make the agreed use of the event or rental object for reasons within his sphere of risk, he shall remain obliged to pay the agreed price. This also applies to any partial services ordered.
If the organiser notifies S.I.C. Stars in Concert Veranstaltungs GmbH of its inability to perform, the following applies with regard to the cancellation compensation to be paid depending on the time of receipt of the notification to S.I.C. Stars in Concert Veranstaltungs GmbH before the official start of the event:
Receipt of the notification:
- up to one year before the start of the event: 50% of the contractually agreed price
- up to 8 months before the start of the event: 75% of the contractually agreed price
- up to 6 months before the start of the event: 100% of the contractually agreed price

XIV. Agencies
1. Agencies only have the right to sell tickets on behalf of S.I.C. Stars in Concert Veranstaltungs GmbH if they have a valid contract. They are obliged to inform customers about the valid terms and conditions of S.I.C. Stars in Concert Veranstaltungs GmbH and to hand these over (agency matter).
2. Agencies are only authorised to receive the ticket price agreed with S.I.C. Stars in Concert Veranstaltungs GmbH in trust. The agencies are obliged to keep the amount received in trust separate from their own assets and to prove this to S.I.C. Veranstaltungs GmbH on request.
3. In the event of violations, S.I.C. Veranstaltungs GmbH reserves the right to exclude the respective agency from purchasing tickets.
4. Agencies that do not have a valid contract only place orders in their own name. In the case of orders placed by agencies, S.I.C. Stars in Concert Veranstaltungs GmbH may demand that acceptance of the order is made dependent on the provision of a security amounting to 80% of the order value.
5. The terms and conditions of S.I.C. Stars in Concert Veranstaltungs GmbH apply exclusively; conflicting agreements between the agencies and third parties are neither transferable nor will they be accepted by S.I.C. Stars in Concert Veranstaltungs GmbH.
XV. Final provisions
1. The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
2. The place of fulfilment and payment is the registered office of S.I.C. Stars in Concert Veranstaltungs GmbH.
3. The law of the Federal Republic of Germany shall apply to contracts between us and the customer to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular of the country in which the customer as a consumer has his habitual residence, shall remain unaffected.
4. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and S.I.C. Stars in Concert Veranstaltungs GmbH is the registered office of S.I.C. Stars in Concert Veranstaltungs GmbH.
5. Should individual provisions of these General Terms and Conditions be invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
